How to read this draft. It is written in plain English on purpose; the attorney decides what must become more formal.
[BRACKETS]are blanks. [ATTORNEY: ...] notes give our proposed choice, the alternative, and why it matters; they are removed before publishing. The facts behind each clause, with their source files, are in "Drafting notes" at the end. Companion documents: the Wampus Community Guidelines (docs/legal/community-guidelines.md), the Wampus Privacy Policy and the Wampus Children's Privacy Notice (written separately), and docs/legal/store-eula-note.md (Apple's standard licence or ours).
Wampus Terms of Service
Effective [EFFECTIVE DATE] · Version [1] (the in-app TERMS_VERSION)
The short version (this box is a summary only; the full terms below are what apply):
- Chaos Champs is free to play. You can buy cosmetic skins. A skin is a licence to use it in the game, not property, and it has no cash value. Refunds go through Apple or Google.
- Matches may include computer-controlled players that look like other players. How well they play adjusts to your results. Every match counts.
- Play fair and be kind. We can reset names and ban accounts that break the rules.
- You can delete your account at any time in the game or at https://account.wampus.games/delete.
- Section 17 explains how disputes are handled under Texas law.
[ATTORNEY: if arbitration is chosen, this box must say so in bold and point to the opt-out.]
1. Who we are and what these terms cover
1.1 Who we are. These terms are an agreement between you and Wampus Studios LLC, a Texas limited liability
company doing business as "Wampus" ("Wampus", "we", "us", "our"). Our address is 1734 E El Paso
St. Ste 190, Fort Worth, TX 76102, United States. Email: yo@wampus.games. Website: https://wampus.games.
[ATTORNEY: the DBA "Wampus" is being filed (DECISIONS 2026-11-05). Proposed: name the LLC as the party everywhere and mention the DBA once, as here. Alternative: wait to publish until the assumed-name certificate is on file. Why it matters: the contracting party must be a real legal person; the App Store will show the LLC as seller.]
1.2 What the "Services" are. These terms cover all of the following (together, the "Services"):
- Chaos Champs, our game, as an app for iPhone / iPad and Android, and the online servers its matches run on;
- Wampus ID, the shared player account, and the account page at https://account.wampus.games;
- arcade cabinets at venues that run Chaos Champs (section 10);
- our website https://wampus.games and our support by email;
- any other Wampus game that says these terms apply to it (each a "Game"). A Game may add its own rules ("Game Rules"); if a Game Rule conflicts with these terms, the Game Rule wins for that Game only.
1.3 Other documents that are part of these terms. The Wampus Community Guidelines (our rules of conduct, in plain words) are part of these terms. The Wampus Privacy Policy explains what information we collect and how we use it; please read it. If you got the app from Apple's App Store or Google Play, their terms also apply to you (section 13).
1.4 Accepting these terms. Before you choose a player name, the game shows you these terms and the Privacy Policy
and asks you to tap I AGREE. You cannot choose a name or play online until you do. By tapping I AGREE, or by using
the Services, you agree to these terms. If you do not agree, do not use the Services.
[ATTORNEY: the built flow is: age question -> terms screen with links + a single I AGREE (no decline button) -> name. We record the newest accepted version and the time, on the account and per install (no IP address, device or copy of the wording). Proposed: keep this clickwrap and add the version date to the screen. Questions: (a) is acceptance AFTER the age question fine (the guest account and its age band exist before the tap)? (b) is the record enough evidence of acceptance, and should it outlive account deletion for disputes? (c) a guest who never reaches the name screen has not tapped I AGREE: does "by using the Services" bind them? (lawyer-questions 36)]
2. Who can play, and Young Players
2.1 Your age. The first time you play, we ask your birth month and year. Please answer truthfully. You can answer only once on each install of the app. Our support team can move an account to a younger age group if we believe the player is younger than they said; we never move an account to an older one.
2.2 Young Players. Players under 16 are "Young Players". Young Players play as guests (section 3.1), choose
from generated player names, cannot create a Wampus ID, and are not shown personalised offers. The Wampus
Children's Privacy Notice explains how we treat Young Players' information.
[ATTORNEY: is 16 the right line everywhere we launch (lawyer-questions 5)? Under-13s: we built "guest only, no email, generated name" so that we collect no personal information beyond a random account ID; is that inside COPPA's support- for-internal-operations exception, or do we need verified parental consent (lawyer-questions 6, 11)?]
2.3 Parents and guardians. If you are under 18 (or under the age of majority where you live), a parent or legal
guardian must read and agree to these terms with you. By letting a minor use the Services, the parent or guardian
agrees to these terms for the minor and for themselves, and is responsible for the minor's use of the Services,
including purchases. Young Players see this message before they choose a name: "Read our rules with a parent or
guardian. They need to agree to them too."
[ATTORNEY: proposed: rely on the in-app message plus this clause. Alternative: a real parent step (a parent's email and a code) for Young Players. Why it matters: minors can generally disaffirm contracts, so the parent's agreement is what makes the dispute, liability and purchase clauses hold; Texas SB 2420 also requires parental consent for minors' app-store downloads and purchases, and its enforcement status has changed several times in 2026 (lawyer-questions 10, 37).]
2.4 Who may not use the Services. You may not use the Services if: the law where you live does not allow it; we have banned you before (unless we agree in writing); or you are in a country under a U.S. Government embargo or on a U.S. Government list of prohibited or restricted parties.
2.5 Wampus ID is for players 16 and over (for now). We may offer accounts for younger players later, with a parent's consent, and will update these terms first.
3. Your account
3.1 Guest accounts. When you first open the app, we create a guest account for you. No email or password is needed. The key to a guest account is stored only on your device, in its secure storage, so a guest account can be lost: on Android, uninstalling the app, clearing its storage or changing phones loses it; on iPhone it survives an uninstall and moves to a new iPhone only through an encrypted backup. We cannot recover a lost guest account. Guest accounts that never answered the age question and are not used for 90 days are deleted.
3.2 Wampus ID. If you are 16 or over, you can create a Wampus ID by adding your email address to your account. You sign in with a one-time code we email to you (8 digits, valid for 10 minutes); there is no password. Your Wampus ID lets you play the same account on other devices and in other Wampus Games. Once an email address is attached to an account, it cannot be removed or changed to another account.
3.3 Switching, never merging. Signing in to a Wampus ID on a device switches that device to the Wampus ID's account. Accounts are never merged: the guest account stays on the device, and you can switch back to it with "play without ID". We cannot combine two accounts or move progress, stats or items from one account to another (except as described in section 5.7 for store purchases).
3.4 Signing out. If a Wampus ID is not used on a device for 180 days, that device is signed out; sign in again with a new code. You can sign out all your other devices from your profile ("SIGN OUT OTHER DEVICES"). A guest account cannot be signed out (its key is its only way in).
3.5 Keeping your account safe. Keep your email account secure: anyone who can read your email can sign in to your Wampus ID. We will never ask you for your sign-in code; never give it to anyone. You are responsible for what happens on your account. Tell us at yo@wampus.games if you think someone else is using it.
3.6 Your account is personal. Do not sell, buy, trade, give away, share or lend accounts, and do not use someone else's account. We may close accounts that change hands.
3.7 Deleting your account. You can delete your account at any time: in the game (Profile -> DELETE ACCOUNT) or at https://account.wampus.games/delete.
- A guest account is deleted at once. This cannot be undone.
- A Wampus ID account is signed out everywhere and deleted 30 days later. Signing in during those 30 days cancels the deletion.
- Deleting removes your account, your player name, your progress and stats, and every skin, including skins you paid for, in every Wampus Game that uses the account. It does not refund purchases (section 5.6).
- A few records are kept after deletion, as the delete screen and the Privacy Policy explain: purchase records without your account on them (for tax and refunds); reports you made (without your identity) and reports made about you; and, if the account was banned, a scrambled (hashed) copy of its email address for 365 days so the ban still applies (section 9.4). Our backups are gone within 7 days of the deletion.
- A banned account can still delete itself, in the app or on the account page.
[ATTORNEY: confirm what the policy may promise about the 30-day grace and the 7-day backups, and how long each kept record may be kept (lawyer-questions 24, 25, 30, 31, 38). The Privacy Policy and its retention schedule are the controlling statements; this section must match them word for word on the numbers.]
3.8 Inactive accounts. [ATTORNEY + Joel: other than the 90-day rule for guests who never answered the age question (3.1), nothing closes long-inactive accounts today. Proposed: say nothing more now. Alternative: "We may close an account that has not been used for [2] years, after notice by email where we have one." Why it matters: if we ever want to close dormant accounts (which hold paid skins), the right must be in the terms before the purchase.]
4. Your licence to use the Services
4.1 What we give you. As long as you follow these terms, we give you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the Services for your own non-commercial entertainment. On iPhone and iPad, you may use the app on Apple-branded devices you own or control, as Apple's Usage Rules allow (including Family Sharing where it applies).
4.2 What we own. We and our licensors own the Services and everything in them: the games, champs (characters), skins, art, maps, music, sound, code, names and logos. These terms do not give you any ownership of them. Apart from the licence in 4.1 and 5.2, we keep all rights.
4.3 What you may not do. Except where the law allows it, you may not: copy, sell, rent, lend, sublicense or
distribute the Services; modify them or make derivative works; reverse-engineer, decompile or try to get the source
code; remove notices of ownership; or use the Services to build a competing product. Some parts of the app are open-
source software under their own licences, listed in the app [ATTORNEY + Joel: the open-source notices screen is not built; lawyer-questions 22]; those licences apply to those parts.
4.4 Videos and streams. You may stream and post videos and screenshots of your own play, and earn money from them
on video and streaming platforms, as long as you do not suggest Wampus endorses you and you follow the Community
Guidelines. We may withdraw this permission for anyone, or change it, at any time.
[ATTORNEY: proposed: allow it (common for games; free marketing). Alternative: leave it out and rely on a separate "video policy" page. Why it matters: without it, every gameplay video is technically outside the licence.]
4.5 Updates. We may release updates, and you may need the latest version to play online. Some updates install automatically, depending on your device settings.
4.6 Your ideas. If you send us ideas, suggestions or feedback, we may use them freely without paying you or crediting you.
5. Skins and purchases
5.1 What you can buy. In Chaos Champs you can buy skins: cosmetic looks for the champs. Skins change how a champ looks; they do not change how it plays. Each skin is a one-time purchase. The game has no in-game currency, no loot boxes or other purchases with random contents, no random rewards for money, and no sweepstakes, contests or prizes. If we ever add any of these, we will update these terms first.
5.2 A skin is a licence, not property. When you buy a skin, you get a personal, limited, non-transferable,
revocable licence to use it in the Game on your account, under these terms. You do not own it. Skins and any other
virtual items have no cash value. They cannot be sold, traded, transferred, gifted or exchanged for money or
anything of value, inside or outside the Services, and we will never buy them back.
[ATTORNEY: is "licence, no cash value, lost on deletion or ban" fair and enforceable as written (lawyer-questions 15)? "Revocable" is standard but sits uneasily with paid items; see 5.8 and 9.4.]
5.3 How buying works. All purchases are made through the Apple App Store or Google Play, using our purchase provider RevenueCat, and are subject to the store's terms. The store sets and shows the price (including any tax) and asks you to confirm before you are charged. A skin is added to your account once our records confirm the store's payment, usually within a few seconds. Nothing is sold at arcade cabinets.
5.4 Young Players and purchases. Young Players can buy skins. Before they buy, the shop asks them to check with a
parent or guardian. Parents can control purchases with Apple's Ask to Buy and Screen Time or Google's Family Link;
when a purchase is waiting for a parent's approval, the shop waits too. Parents and guardians are responsible for
purchases made by the minors in their care.
[ATTORNEY: proposed: keep purchases on for Young Players, with the note and the stores' controls. Alternatives: purchases off for under-13s, or for all under-16s, until a parent step exists. Why it matters: FTC v. Epic (2022-23: $245M redress for purchase designs and unauthorized charges, plus $275M under COPPA) and Texas SB 2420's parental consent for minors' purchases (lawyer-questions 14, 27).]
5.5 Where your skins work. Your skins are tied to your account. You can use them wherever you play that Game on that account, on any device and at arcade cabinets. Items belong to the Game they were bought for (a Chaos Champs skin is not usable in another Wampus Game unless we say so). Computer-controlled players (section 6) never wear paid skins.
5.6 Refunds. Refunds are handled by Apple or Google under their refund policies; ask them, not us. We do not give
refunds directly, except where the law requires it. If a purchase is refunded, we remove the skin it bought; if the
store reverses the refund, the skin comes back. We will not ban or limit an account because its owner asked the
store for a refund or disputed a charge with their bank; we only remove the refunded item.
[ATTORNEY: (a) consumer-law refund rights in launch regions (for example the EU / UK 14-day rule for digital content, if we launch there; lawyer-questions 19). (b) The bold sentence is our proposal, matching what the code does: the FTC's Epic complaint said Epic locked the accounts of customers who disputed charges. Alternative: reserve the right to act on fraud or repeated chargebacks. Why it matters: it is a promise; it must stay true.]
5.7 Restore Purchases. If a skin you bought is missing, use RESTORE PURCHASES on your profile or in the shop.
Purchases follow the store account (Apple ID or Google account) that paid for them: if you restore while signed in to
a different Wampus account, the store may move those purchases, and the skins, to that account.
[ATTORNEY + Joel: this "transfer on restore" is RevenueCat's behaviour (the purchases service handles its TRANSFER event by moving the items); RevenueCat lets us choose the restore behaviour. Proposed: keep transfer and disclose it as above. Why it matters: it is the one case where items move between accounts, and a shared family device could move a parent's skins to a child's guest or back.]
5.8 Changes to skins. We may change how a skin looks or works, for example to fix bugs, keep the game fair or update the art. We will not take away a skin you paid for except as these terms say: if it is refunded (5.6), if your account is deleted (3.7) or banned (9.4), or if the Game ends (12.3).
5.9 Losing items. You lose your skins if you delete your account or if we ban it for breaking these terms. A ban
does not entitle you to a refund, except where the law requires it.
[ATTORNEY: proposed: no refund on a ban. Question: should there be a refund path for paid items when a ban turns out to be a mistake (we would restore the account instead, since a ban can be reversed)? (lawyer-questions 15)]
6. Matches, matchmaking and computer-controlled players
6.1 Online play. Chaos Champs needs an internet connection. Matches run on our servers, so we can keep stats honest and stop cheating. There is no offline play.
6.2 Computer-controlled players. Matches may include computer-controlled players ("bots"). When not enough people are online, we fill the empty seats with bots after a short wait. If a player stops playing or loses their connection during a match, a bot may play for them until they return. Bots may have player-style names and look like other players; they are not labelled in matches. Bots never wear paid skins, never send invitations or friend requests, and never try to sell you anything.
6.3 Bot difficulty adapts to you. How well bots play adjusts to your recent results: they get tougher while you keep winning and easier after losses. You cannot choose bot difficulty.
6.4 Every match counts. Every match counts toward your stats and crowns, including matches with bots and matches in which a bot played for you while you were away.
[ATTORNEY: the biggest judgment call in this document (lawyer-questions 13, 23; STORE-READINESS L3). Built today: unlabelled bots with player-style names and look-alike player tags, adaptive difficulty, idle takeover, every match counts; bots carry the same Report / Block menu as people; a report on a bot gets the same "thanks, we review within 72 hours" reply and is then discarded. Proposed: disclose in these terms (6.2-6.4, in bold), in the FAQ, and in the store listing ("matches may include computer-controlled players"), and add the sentence in 6.5. Alternatives: (a) label bots in matches; (b) label bots only for Young Players. Why it matters: FTC Act section 5 (deception), children in the audience, and the paid shop. California's bot law (Bus. & Prof. Code section 17940, operative 2019) targets bots that communicate with people to incentivize a purchase; our bots do not chat or sell, but the attorney should confirm it does not reach us.]
6.5 Reporting or blocking a bot. You can block any player in a match, including a bot. [ATTORNEY: proposed sentence, not yet agreed: "If you report a computer-controlled player, there is no person to act against, so the report is closed without review." Alternative: say nothing (today's build). Why it matters: the in-game reply promises a review within 72 hours to everyone; saying nothing may be the deceptive part.]
6.6 Matchmaking and ranking. We try to make matches fair but do not promise any particular opponents, teammates, wait time or result. Your ranking points are called crowns. We may adjust or reset crowns, stats or results that came from cheating, exploits, bugs or server faults, and we may change how crowns work.
7. Rules of conduct
7.1 You agree to follow the Wampus Community Guidelines. In particular, you agree not to:
- choose a player name, or act in a way, that is offensive, hateful, sexual, threatening or harassing, that impersonates anyone (including Wampus staff), that contains personal information (yours or anyone else's, such as a real name, address, school, phone number or social media account), or that advertises anything;
- cheat: use cheats, hacks, bots, scripts, macros, modified apps, emulators made to gain an advantage, or exploits of bugs; deliberately lose, trade wins or "feed" to manipulate results or crowns;
- harass, bully or grief other players, or deliberately ruin matches;
- interfere with our servers, other players' connections or our security measures; probe, scan or test them for weaknesses (except under a written security-research permission from us); overload them; or get around a limit, a block or a ban;
- buy, sell, trade, share or transfer accounts or items, or offer "boosting" or other paid services in or around the Services;
- use the Services for any commercial purpose not allowed in 4.4;
- make false reports, or encourage others to report a player falsely;
- break any law, or help or encourage anyone else to break these rules.
7.2 One person playing several seats at an arcade cabinet is allowed; it is not cheating.
8. Player names, reports and blocks
8.1 Your player name is your content. Players 16 and over may type their own player name (3 to 14 letters,
numbers, spaces, _, . or -); Young Players choose from generated names. Your first name choice is free; after
that you can change your name once every 7 days. Each account also has a player tag (a short code such as #4RXQ4669)
that we assign.
8.2 What you allow us to do with it. Your player name is shown to other players, at arcade cabinets and in places such as results screens and public stats. You give us a worldwide, royalty-free licence to store, show and use your player name to run, promote and improve the Services, for as long as your account exists (and afterwards in kept records, section 3.7). You are responsible for your name, and you promise it does not break these terms or anyone else's rights.
8.3 Name filter. Names are checked against a filter for offensive words. The filter is not perfect; a name that passes it can still break the rules.
8.4 Reporting. You can report a player from the "..." menu on their card on the end-of-match screen. Choose a reason: their name, cheating, or griefing. We aim to review reports within 72 hours. We may not tell you what we did about a report, and we do not tell the reported player who reported them.
8.5 Hidden names. If three different players report the same name within 24 hours, that name is shown as "Player" to everyone until we review it.
8.6 Blocking. You can block a player from the same menu. A blocked player's name is shown to you as "Player", and where possible we avoid putting you in the same match. The blocked player is not told. Your blocked list is on your profile.
8.7 Our role. We are not required to watch or check everything players do, but we may review, hide, reset or remove any player name, and act on any account, at any time, as section 9 describes. To contact us about a name or a player, write to yo@wampus.games.
9. What we can do if the rules are broken
9.1 Actions. If we believe you broke these terms or the Community Guidelines, we may, depending on how serious it is and whether it happened before: warn you; hide your player name or replace it with a generated one; remove crowns, stats or results gained unfairly; limit features; suspend your account for a time; or ban your account permanently, including its skins. We may also act against other accounts we reasonably believe you control.
9.2 Without notice. We may act without notice where it is needed to protect players, the Services or the law. A ban reaches our servers and arcade cabinets within about 15 minutes.
9.3 What a ban means. A banned account cannot play or sign in, and its skins cannot be used. We may refuse to let you create a new account. A banned account can still delete itself (3.7).
9.4 Bans outlast deletion. If a banned Wampus ID account is deleted, we keep a scrambled (hashed) copy of its email
address, not the address itself, for 365 days, and refuse a new Wampus ID with that email during that time.
[ATTORNEY: is 365 days defensible against our deletion promises (store rules, state privacy laws, COPPA)? The same question covers the per-install age marker kept after a guest is deleted (lawyer-questions 24).]
9.5 Appeals. If you think we made a mistake, email yo@wampus.games within [30] days of the action, with your
player tag and what happened. A person will review it. If we find we were wrong, we will undo the action and restore
what we removed.
[ATTORNEY + Joel: proposed: a 30-day window and a human review, no fixed answer time. Alternative: promise an answer within [14] days. Why it matters: a promised time is a promise we must keep with a one-person staff.]
10. Arcade cabinets at venues
10.1 Venues. Some venues (for example arcades and family entertainment centers) have Chaos Champs cabinets. The
venue, not Wampus, runs its premises and decides its own prices, opening hours and house rules; any fee you pay to
play at a venue is between you and the venue. Please follow the venue's rules and staff.
[ATTORNEY: the agreement between Wampus and each venue (who owns and maintains the cabinet, who answers for injuries on the premises, who may see what) is separate and not drafted. Proposed: these player terms say only what is above.]
10.2 Signing in at a cabinet. You can play at a cabinet without signing in, with the free looks. To play as yourself, scan the cabinet's QR code with the Chaos Champs app, then confirm on the cabinet's own screen that it is you ("IS THIS YOU?", within 15 seconds, with that cabinet's controls). Until you confirm, nothing changes at the cabinet; if you say no or do not answer, you play as a guest. No account is created at a cabinet. Young Players can sign in at cabinets too.
10.3 What happens when you are signed in. The cabinet shows your player name on its screen, where people nearby can see it. Your skins work there and your matches count toward your stats. Your sign-in ends 2 hours after you scanned, when you sign in at another position, when someone else signs in at your position, when the cabinet is left idle, or if your account is banned or deleted. If you walk away during a match, a bot may play for you and the match still counts.
10.4 Nothing is sold at cabinets. You cannot buy skins at a cabinet.
11. Health and safety
11.1 Chaos Champs has flashing lights and fast-moving images. A very small number of people may have seizures when exposed to flashing lights or patterns, even with no history of epilepsy. If you or anyone in your family has had a seizure or epilepsy, talk to a doctor before playing. Stop playing at once and see a doctor if you feel dizzy, have blurred vision, eye or muscle twitches, loss of awareness, disorientation or any involuntary movement.
11.2 Take breaks. Be aware of your surroundings, especially at venues and when playing on a phone. Do not play while driving or doing anything that needs your attention.
12. Availability, changes and ending the Services
12.1 Availability. We work to keep the Services running but do not promise they will always be available, on time, secure or free of errors. We may pause them for maintenance, and they may not be available in every country.
12.2 Changes. We may change, add or remove any part of the Services at any time, including champs, modes, maps, balance, crowns, features and items, and how bots and matchmaking work.
12.3 Ending a Game. We may stop offering a Game or the Services altogether. If we do, we will give at least
[90] days' notice in the Game and on https://wampus.games when we can. When a Game ends, your licence to use it and
its skins ends too. We do not refund purchases when a Game ends, except where the law requires it.
[ATTORNEY: proposed: [90] days' notice and no refunds. Alternatives: refund (or ask the stores to refund) purchases made in the last [30-90] days before the announcement; or stop selling at the announcement. Why it matters: shutdowns of online games with paid items draw consumer complaints and regulator interest; Apple guideline 3.2.1(iii) says purchased items "may not expire" (written about rentals, but the attorney should read it against a shutdown).]
13. Apple, Google and other third parties
13.1 Store terms. If you got the app from the Apple App Store, Apple's Media Services Terms and Conditions also apply; if from Google Play, the Google Play Terms of Service also apply. You must follow any third-party terms that apply to you when using the Services (for example, your mobile data plan).
13.2 Terms for App Store users. If you got the app from the Apple App Store:
- these terms are between you and Wampus only, not Apple, and Wampus (not Apple) is solely responsible for the app and its content;
- the licence in 4.1 is limited to Apple-branded products you own or control, as Apple's Usage Rules allow;
- Apple has no obligation at all to provide maintenance or support for the app;
- if the app fails to meet any warranty that applies, you may tell Apple, and Apple will refund the purchase price of the app (if any) to you; to the extent the law allows, Apple has no other warranty obligation for the app;
- Wampus, not Apple, is responsible for any claims about the app (including product liability claims, claims that it fails to meet any legal or regulatory requirement, and claims under consumer protection, privacy or similar laws);
- if anyone claims the app or your use of it infringes their intellectual property, Wampus, not Apple, is responsible for investigating, defending, settling and discharging that claim;
- you confirm that you are not in a country under a U.S. Government embargo or one the U.S. Government has designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties;
- questions, complaints or claims about the app go to Wampus Studios LLC, 1734 E El Paso St. Ste 190, Fort Worth, TX
76102, yo@wampus.games,
[SUPPORT PHONE NUMBER]; - Apple and its subsidiaries are third-party beneficiaries of these terms, and once you accept them, Apple may enforce
them against you.
[ATTORNEY: this section only matters if we use our own licence on the App Store instead of Apple's standard EULA (see docs/legal/store-eula-note.md); it follows Apple's "Instructions for Minimum Terms of Developer's End-User License Agreement" (10 items, read 2026-11-05). Item 8 requires a telephone number: we have none yet.]
13.3 Google Play. If you got the app from Google Play, these terms are between you and Wampus, not Google. Where Google's Developer Distribution Agreement conflicts with these terms, Google says its agreement wins.
13.4 RevenueCat and venues. RevenueCat processes purchase records for us; venues run cabinets (section 10). Neither is a party to these terms.
14. Disclaimers
14.1 TO THE FULLEST EXTENT THE LAW ALLOWS, THE SERVICES (INCLUDING ALL SKINS AND OTHER ITEMS) ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, OR THAT PROGRESS, STATS OR ITEMS WILL NEVER BE LOST.
14.2 We are not responsible for what other players do or for player names, though we act on them as section 9 says.
14.3 Some places do not allow these disclaimers, so some may not apply to you.
[ATTORNEY: draft the final wording; capitals are a placeholder for "conspicuous". Texas law on implied-warranty disclaimers for software/services and any game-specific points are for the attorney.]
15. Limitation of liability
15.1 TO THE FULLEST EXTENT THE LAW ALLOWS: (a) WAMPUS AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS AND LICENSORS ARE
NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST
DATA, LOST PROGRESS OR LOST ITEMS, EVEN IF WE WERE TOLD THEY MIGHT HAPPEN; AND (b) OUR TOTAL LIABILITY FOR ALL CLAIMS
ABOUT THE SERVICES OR THESE TERMS IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR PURCHASES IN THE SERVICES IN THE 12
MONTHS BEFORE THE CLAIM AROSE, OR [US $50].
15.2 Nothing in these terms limits liability that cannot be limited by law (for example for fraud, or for death or
personal injury caused by negligence where the law forbids limiting it), or takes away rights you have under consumer
protection laws that cannot be waived, including the Texas Deceptive Trade Practices-Consumer Protection Act.
[ATTORNEY: proposed: $50 floor (the same figure as Apple's standard EULA) and an explicit DTPA saving clause. Our reading, for you to confirm: under Tex. Bus. & Com. Code section 17.42 a consumer can waive DTPA rights only in a signed writing, in a set form and bold type, while represented by their own lawyer, so a click-through cannot do it and should not appear to try. Alternative: a higher cap, or no cap for Young Players.]
16. Indemnity
16.1 If someone else makes a claim against us because you broke these terms or the law, or because of a player name
you chose, you agree to cover our reasonable losses and costs (including reasonable lawyers' fees) from that claim, to
the extent the law allows. We will tell you about the claim and may control its defence.
[ATTORNEY: proposed: a narrow indemnity tied to the player's own breach. Alternative: drop it. Why it matters: consumer indemnities are rarely used, can look one-sided to a regulator or court, and may not bind minors; most of the protection comes from section 15 anyway.]
17. Disputes
17.1 Talk to us first. If you have a problem with the Services, most issues are solved quickly by email: write to
yo@wampus.games. Before either of us starts a formal claim (in court or, if 17.4 Option B is chosen, in arbitration),
the one making the claim must send the other a written notice describing it and what they want: you to yo@wampus.games
and to our postal address, we to the email on your account (if any). We both then try in good faith to resolve it for
[60] days. Time limits for bringing the claim pause during those days.
[ATTORNEY: proposed: a 60-day informal step for both sides, with a tolling sentence so it cannot cost anyone a deadline. Alternative: 30 days, or a short video / phone call requirement as some publishers use. Why it matters: it filters most complaints cheaply, and it is a precondition many arbitration clauses rely on to blunt mass filings.]
17.2 Governing law. These terms, and any dispute between you and us about the Services or these terms, are governed
by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law rules.
[ATTORNEY: if Option B is chosen, add that the Federal Arbitration Act governs the arbitration clause.]
17.3 Where disputes are heard (if not arbitrated). [ATTORNEY: proposed: the state courts in Tarrant County, Texas, or the U.S. District Court for the Northern District of Texas, Fort Worth Division, and both of us consent to those courts. Either of us may instead bring an individual claim in a small claims court (in Texas, a justice court) where you live or in Tarrant County, if it qualifies. Alternative: courts where the player lives. Why it matters: a far-away forum for a consumer can be challenged, and some states' laws limit it; Tarrant County is our address.]
17.4 Court or arbitration. [ATTORNEY: DECISION NEEDED. Two options are drafted below; we have not chosen. Pick one and delete the other.]
Option A: courts, no arbitration. Disputes go to the courts in 17.3. Nothing in these terms waives class actions.
Option B: individual arbitration, class-action waiver, opt-out. Except for small-claims cases and claims about intellectual property or misuse of the Services (which may go to court), any dispute that the informal step in 17.1 does not resolve will be decided by binding individual arbitration administered by
[the American Arbitration Association under its Consumer Arbitration Rules | JAMS], not in court, and you and we each give up the right to a jury trial and to take part in a class action or class arbitration. We pay the arbitration fees beyond[the consumer filing fee]. If 25 or more similar claims are filed by the same lawyers, they are handled in batches[mass-arbitration terms]. You can opt out of this arbitration agreement by emailing yo@wampus.games with your player tag and "arbitration opt-out" within 30 days of first accepting these terms. If the class-action waiver is found unenforceable for a claim, that claim goes to court under Option A, not to class arbitration.
| Option A: courts | Option B: arbitration + class waiver | |
|---|---|---|
| Cost per dispute | court costs mostly on the claimant; no per-case fees for us | we usually pay most arbitration fees for consumer cases, even small ones |
| Class actions | possible | generally barred for those who don't opt out (enforceability of class waivers under the FAA is the attorney's call) |
| Mass filings | not a special risk | the known risk: thousands of individual demands, each with fees; Valve (Steam) dropped arbitration and its class waiver in Sept. 2024 after mass arbitration |
| Publicity | public | private |
| Minors | as any contract | a minor may disaffirm; the parent's agreement (2.3) matters more |
| Outside the US | local consumer courts usually apply anyway | often unenforceable against consumers in the EU / UK |
| Wording burden | short | long, must be conspicuous, needs the opt-out and batching rules |
17.5 Time limit. [ATTORNEY: we did NOT add a short "bring claims within one year" clause: our reading is that Tex. Civ. Prac. & Rem. Code section 16.070 voids a contractual limitations period shorter than two years. Confirm, or set a two-year period.]
17.6 Players outside the United States keep the protections of the consumer laws where they live that cannot be changed by contract.
18. Changes to these terms
18.1 We may change these terms. We will post the new version at https://wampus.games/terms with its effective date.
18.2 For important changes, we will tell you in the Game before they apply and ask you to accept them again (the terms screen appears on every device). If you do not agree, stop using the Services; you can delete your account (3.7). If you keep playing after a change applies, the new terms apply to you from then on.
18.3 Changes do not apply to a dispute either of us already notified under 17.1 before the change. [ATTORNEY: if Option B: also say that a change to the arbitration clause does not apply to claims that arose before it, and that a player may reject it within 30 days.]
[ATTORNEY: which kinds of change need re-acceptance (a new TERMS_VERSION)? The app can ask every device again; the lawyer decides when it must.]
19. General
19.1 Whole agreement. These terms (with the Community Guidelines, any Game Rules and the documents they name) are the whole agreement between you and us about the Services, and replace any earlier ones.
19.2 If part is invalid. If a court finds part of these terms unenforceable, the rest stays in force, and that part applies as far as the law allows.
19.3 No waiver. If we do not enforce a term right away, we can still enforce it later.
19.4 Transfer. You may not transfer these terms or your account. We may transfer these terms to a company that takes over a Game or the Services, or to a company in our group, with notice to you.
19.5 Events outside our control. We are not responsible for delays or failures caused by things outside our reasonable control, such as outages of the stores, networks or hosting providers, natural disasters, or changes in law.
19.6 Ending these terms. You can stop using the Services at any time and delete your account. Sections that by their nature should continue (for example 4.2, 5.2, 9.4, 14-17 and 19) continue after these terms end.
19.7 Notices. We may send you notices in the Game, on https://wampus.games or to the email on your Wampus ID. You can send us notices at yo@wampus.games and our postal address.
19.8 Language. These terms are written in English. If we provide a translation and they differ, the English version applies, except where the law says otherwise.
19.9 Export. You must follow U.S. export and sanctions laws when using the Services.
